These Terms of Use (the "Terms") are a contract between you and EVRIUS s.r.o., Kaprova 42/14, 110 00 Praha 1 – Staré Město, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague ("we", "us", "our"). They govern your use of the website https://lock-wheel-vpn.com (the "Website"), the Lock Wheel VPN applications (the "App") and the Lock Wheel VPN virtual private network service, including any subscription (together, the "Service").
Please read the Terms carefully. By creating an account, buying a subscription, or using the App or the Service after accepting these Terms on the App's first-launch screen, you agree to them. If you do not agree, do not use the Service. The App is also licensed to you under our End User License Agreement at https://lock-wheel-vpn.com/eula (the "EULA"). Our Privacy Policy at https://lock-wheel-vpn.com/privacy explains how we process personal data.
If you are a consumer, meaning an individual acting for purposes outside your trade, business or profession, nothing in these Terms limits the rights you have under mandatory consumer protection law, in particular the Czech Civil Code (Act No. 89/2012 Coll.) or the law of the EU country where you live.
1. The Service
Lock Wheel VPN encrypts the internet traffic of your device and routes it through a VPN server in the location you choose, using the WireGuard protocol. The App is available for Windows, macOS and Linux as a download from the Website, and will also be available for iOS and Android. The features of each plan, the available server locations and the number of devices are described on the Website and in the App at the time of purchase.
A VPN improves your privacy and security, but no technology can make you completely anonymous or protect you against every threat. For example, the Service does not protect you against malware, phishing, or tracking by websites you sign in to. We do not promise that any particular website, streaming service or online service will be accessible through the Service, or that it will work with any particular network.
Some features may be offered without a subscription. Others, including connecting to the VPN unless stated otherwise in the App, require an active subscription ("Premium").
2. Who may use the Service
- You must be at least 16 years old to use the Service.
- To buy a subscription, you must be of legal age to enter into a binding contract where you live, or have permission from your parent or legal guardian.
- You may not use the Service if the law where you are, or a sanctions regime that applies to you or to us, prohibits it.
- You are responsible for checking that using a VPN is lawful where you use it. Some countries restrict or prohibit VPNs.
3. Your account
You can use the App without registering. To buy and use a subscription on several devices, you need an account with a valid email address and a password. If you buy a subscription on the Website, your account is created with the email address and password you enter at checkout.
- Keep your account details accurate and your password confidential. You are responsible for anything done through your account that results from you not keeping your password confidential.
- An account is for one person and their own devices. Do not share, sell or transfer it.
- Sign-in links we send you, such as password reset and automatic sign-in links, are for your use only.
- If you think someone else has access to your account, change your password and tell us at contact@evrius.com.
4. Subscriptions, prices and payment
Subscriptions are sold on the Website by EVRIUS s.r.o., which is the seller and merchant of record. Payments are processed on our behalf by our payment service provider. Its terms may also apply to the payment itself, and it, not us, receives your full payment details. If the App is later offered through an app store and you buy a subscription there, that store's terms apply to the payment, billing and cancellation of that purchase.
- Before you pay, the checkout shows the plan, its length, the total price in the currency charged (including VAT where applicable), how often you will be charged, and, if offered, the trial or introductory price and when it ends. The price shown at checkout is the price you pay.
- A contract for a subscription is concluded when we confirm your payment. We send you the key terms by email or make them available in your account.
- Subscriptions renew automatically. At the end of each subscription period, the same plan is renewed for the same period and charged to your payment method at the then current price, unless you cancel before the end of the period (section 5).
- If a plan includes a free trial or an introductory price, the regular price is charged automatically when the trial or introductory period ends, unless you cancel before that. Each person may use a free trial only once.
- Your bank or card issuer may charge fees, such as currency conversion fees, which we do not control.
We may change the price of a plan for future periods. We will tell you about a price change for your subscription at least 30 days before it takes effect, by email or in the App. The new price applies from your first renewal after that date. If you do not agree, you can cancel before the renewal, and the change will then not apply to you.
5. Cancelling a subscription
You can cancel your subscription at any time, without giving a reason, on your account page at https://lock-wheel-vpn.com/account or by writing to contact@evrius.com from your account's email address. Cancelling stops the next renewal. You keep Premium until the end of the period you have already paid for, after which the subscription ends and you are not charged again.
Apart from your right of withdrawal (section 6) and your statutory rights when the Service is defective (section 12), no refund is given for the remaining part of a period when you cancel. Uninstalling the App or deleting your account on a device does not cancel a subscription by itself, although we stop renewals of subscriptions bought on the Website when we delete your account at your request.
6. Right of withdrawal for consumers in the EU
If you are a consumer, you may withdraw from a subscription contract within 14 days of the day it was concluded, without giving any reason. This applies only to the first purchase of a subscription, not to its automatic renewals.
To withdraw, tell us clearly that you have decided to withdraw from the contract, for example by email to contact@evrius.com or by post to EVRIUS s.r.o., Kaprova 42/14, 110 00 Praha 1 – Staré Město, Czech Republic. You may use the model withdrawal form in section 20, but you do not have to. You meet the deadline if you send your notice before the 14 days end.
Access to the Service starts immediately after payment. At checkout, we therefore ask you to expressly request that we start providing the Service during the withdrawal period, and to acknowledge that:
- if you withdraw, you must pay an amount proportionate to the part of the Service provided up to the moment you tell us you are withdrawing, compared with the full period you bought;
- you lose your right of withdrawal once the Service has been fully provided, for example when a subscription period shorter than 14 days has ended.
If you withdraw, we refund all payments we received from you for that contract, less the proportionate amount described above, without undue delay and in any case within 14 days of receiving your notice. We refund you using the payment method you used, unless you expressly agree otherwise, and you will not be charged any fee for the refund. Your Premium access ends when the withdrawal takes effect.
If you did not expressly request an immediate start, or we did not obtain your acknowledgement, you do not have to pay anything for the Service provided during the withdrawal period.
7. Refunds
Apart from withdrawal (section 6) and defects (section 12), payments are not refundable. We may still offer a refund in individual cases at our discretion, for example after a technical problem on our side. Such a refund does not create an obligation in other cases. To ask for a refund, write to contact@evrius.com with your account email address and the date of the payment. Refunds of purchases made through an app store are handled by that store under its own rules.
8. Failed payments and grace period
If a renewal payment fails, we or our payment service provider may try to charge your payment method again over the following days. During this grace period, you keep Premium, and we email you to ask you to update your payment method. If the payment still cannot be collected when the grace period ends, the subscription ends and Premium stops. You can buy a new subscription at any time.
If you dispute a payment with your bank (a chargeback) without first contacting us, we may suspend the subscription until the dispute is resolved. This does not affect your right to dispute an unauthorised payment.
9. Device limit
A subscription can be used on up to 5 devices at the same time, unless the plan you bought states a different number. If you sign in on a device that takes your account over the limit, the device that has been used least recently is signed out automatically. You may sign it in again, and another device will then be signed out. You may not bypass the device limit or let people outside your household use your account.
10. Acceptable use
You may use the Service only lawfully and in a way that does not harm others. In particular, you must not use the Service to:
- commit, prepare or promote a crime or any other illegal activity, including fraud and identity theft;
- create, access, store or distribute child sexual abuse material, or any content that is illegal where you or the recipient are;
- infringe copyright, trademarks or other intellectual property rights, including by unauthorised file sharing;
- send spam or unsolicited bulk messages, or run phishing campaigns;
- attack, probe or disrupt any network, system or device, including denial-of-service attacks, port scanning, brute-force attempts, or distributing malware or botnet traffic;
- harass, threaten or stalk anyone, or incite violence or hatred;
- interfere with the Service or our servers, overload them on purpose, or try to gain unauthorised access to them or to other users' accounts;
- resell, sublicense or commercially provide the Service to others, or create accounts in bulk or by automated means;
- abuse free trials or promotions, for example by creating several accounts.
Because we do not monitor or log your traffic, we do not check what you do through the Service. You remain fully responsible for your online activity. We act on credible reports of abuse, and we may limit traffic patterns that are clearly abusive, such as outgoing mail traffic used for spam, to protect the Service and its users.
To report abuse or an intellectual property infringement related to the Service, write to contact@evrius.com. Because we keep no activity logs, we cannot identify which user, if any, was connected to a VPN server at a given time.
11. Availability and changes to the Service
We work to keep the Service available and fast, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable because of maintenance, updates, failures of networks or providers outside our control, or measures taken by internet providers or governments. Where possible, we will announce planned maintenance in advance.
We may change the Service, for example by adding or removing server locations or features or updating the App. If a change has more than a minor negative effect on a paid subscription, we will tell you in advance, clearly and on a durable medium such as email. You may then end the contract free of charge within 30 days of the change or of our notice, whichever is later, and we will refund the unused part of your paid period. You may need to install updates to keep using the Service securely.
12. Defective Service and complaints
If you are a consumer, you have statutory rights if the Service does not conform to the contract, under the Czech Civil Code provisions on digital content and services and the laws implementing Directive (EU) 2019/770. These include the right to have the Service brought into conformity, and, where that is not possible or not done within a reasonable time, the right to a proportionate price reduction or to end the contract. These rights cannot be excluded or limited.
To make a complaint, write to contact@evrius.com and describe the problem. Logs shared from the App (Settings > About > Share logs) can help us find the cause. We confirm receipt and handle the complaint without undue delay, and in any case within 30 days unless we agree a longer period with you.
13. Intellectual property
The Service, the App, the Website and their content, including the Lock Wheel VPN name and logo, are owned by EVRIUS s.r.o. or its licensors and are protected by law. These Terms do not transfer any of these rights to you. Your right to use the App is set out in the EULA. Open-source components included in the App are licensed under their own licences, as described in the EULA.
If you send us feedback or suggestions, we may use them without any obligation to you.
14. Suspension and termination
You may stop using the Service at any time. You may also ask us to delete your account, as described in our Privacy Policy.
We may suspend your account or end the contract if you seriously or repeatedly breach these Terms, in particular section 10, or if the law or a public authority requires us to. Where reasonable, we will warn you first and give you a chance to remedy the breach. We will tell you the reason, unless the law prevents it. If we end the contract for a reason other than your breach, we will refund the unused part of any paid period.
We may stop providing the Service as a whole by giving at least 60 days' notice, and we will refund the unused part of any paid period.
Sections that by their nature should continue after the contract ends, such as sections 13, 15, 16, 17 and 19, survive termination.
15. Disclaimers
Apart from the commitments made in these Terms and your statutory rights, the Service is provided "as is" and "as available". To the extent the law allows, we make no other promises, including that the Service will meet a particular purpose of yours beyond its description, or that it will make you anonymous or undetectable. We are not responsible for third-party websites or services you access through the Service.
16. Liability
Nothing in these Terms limits or excludes our liability for harm caused intentionally or by gross negligence, for death or injury to a person, or any other liability that cannot be limited under applicable law, including our liability to consumers under mandatory consumer protection law.
Subject to that, and to the extent permitted by law:
- we are liable only for damage that was a foreseeable result of our breach when the contract was concluded;
- we are not liable for loss of data you did not back up, loss of profit or business, or damage caused by your breach of these Terms or of the law;
- our total liability arising out of or in connection with the Service in any 12-month period is limited to the amount you paid us for the Service during those 12 months, or EUR 50 if you paid nothing. This limitation does not apply to consumers to the extent mandatory law does not allow it.
We are not liable for any failure or delay caused by events beyond our reasonable control, such as natural disasters, war, outages of third-party networks or providers, or orders of public authorities.
17. Business users
If you use the Service for your trade, business or profession, the following also applies to you. Section 6 does not apply. You will compensate us for third-party claims, losses and reasonable costs arising from your breach of section 10. To the extent permitted by law, Sections 1799 and 1800 of the Czech Civil Code on adhesion contracts do not apply.
18. Changes to these Terms
We may change these Terms for valid reasons, such as changes to the Service, to the law or to our payment or security arrangements. We will tell you about material changes at least 30 days before they take effect, by email or in the App. If you do not agree, you may end the contract before the change takes effect, free of charge, and we will refund the unused part of any paid period. If you continue to use the Service after the change takes effect, you accept the new Terms. Changes do not apply to periods you have already paid for, unless a change is required by law or is only to your benefit.
19. Governing law and disputes
These Terms and any dispute arising out of or in connection with them are governed by the law of the Czech Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of that country.
The courts of the Czech Republic have jurisdiction. If you are a consumer living in the EU, you may also bring proceedings in the courts of the country where you live, and we may sue you only there.
Please contact us first at contact@evrius.com. Most issues can be resolved quickly that way. If you are a consumer and we cannot resolve a dispute, you may turn to the body for out-of-court resolution of consumer disputes, the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Praha 2, www.coi.cz/en. If you live in another EU country, the European Consumer Centre in your country can help with cross-border disputes. Using out-of-court resolution does not affect your right to go to court.
Supervision of compliance with consumer protection law is carried out by the Czech Trade Inspection Authority, and supervision of personal data protection by the Czech Office for Personal Data Protection (www.uoou.gov.cz).
